Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer and sell products to customers in Australia and selected international destinations.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory warranty, right or remedy that cannot lawfully be excluded under:

Our voluntary returns, refund and warranty arrangements operate in addition to any non-excludable legal rights.
2. Eligibility

Adding a product to your cart does not reserve it. A product may become unavailable before payment or order acceptance.

8. Preorder Products
Some products may be offered for preorder before their official release, production completion or restock date.
The estimated dispatch timeframe will be displayed on the product page, checkout or order confirmation.
By purchasing a preorder product, you acknowledge that:

Payment may be collected when the order is placed;

Dispatch and delivery dates are estimates;

Manufacturing or freight delays may occur; and

An order containing in-stock and preorder products may be held until all products are available.

Where a delay becomes substantial, we may offer you the option to:

Cancel the affected preorder for a refund.
Any mandatory cancellation rights available under the laws of your country remain unaffected.
9. Prices and Displayed Currency
Our base store currency is Australian dollars unless otherwise stated.
International customers may see prices displayed in a local or selected currency. Currency conversion may be provided by Shopify, a payment provider or another service.
The final currency and amount charged will be shown during checkout.
Exchange rates may change between browsing and completing payment.
Your bank, card issuer or payment provider may separately charge:

17. Shipping Addresses
You are responsible for providing a complete and accurate shipping address.

We cannot guarantee that an address can be changed after processing or dispatch.
Additional costs may apply where a parcel must be:

Returned to sender;

Resent; or

Reprocessed
because the customer supplied incorrect or incomplete delivery information.
Nothing in this section limits your rights where the delivery problem was caused by us or our delivery arrangements.
18. Delivery, Risk and Missing Parcels
Delivery timeframes are estimates unless a guaranteed service is expressly stated.
We will take reasonable steps to assist where an order is:

Lost in transit;

Delivered to the wrong address;

Damaged during delivery; or

Incorrectly marked as delivered.
Risk in the products will pass in accordance with applicable law.
Risk does not pass to you merely because we gave the parcel to a carrier where applicable consumer law provides otherwise.
Where you independently arrange a carrier that was not offered or nominated by us, different risk rules may apply.
19. Returns and Refunds
Our voluntary change-of-mind returns are governed by our Return and Refund Policy.
For customers purchasing from Australia, our products come with guarantees that cannot be excluded under the Australian Consumer Law.
For international customers, additional or different mandatory rights may apply under the consumer laws of your country or region.
Where applicable local law gives you:

Original delivery charges are not refunded for change-of-mind returns;

Where the return concerns a confirmed faulty, damaged or incorrectly supplied product, we will provide a remedy and address reasonable return costs as required by applicable law.
International return parcels should be appropriately marked as returned merchandise where permitted. Customers must not provide false customs declarations.
Import duties or taxes paid to a government authority may need to be reclaimed directly from that authority. Refund availability will depend on the destination country’s rules and how the charges were collected.

Your purchase is made from EWA Clothing & Apparel, not Shopify.
Shopify supplies the ecommerce technology used to operate the store and may process information relating to your:

Shopify’s role does not remove any legal rights you may have against EWA Clothing & Apparel or another responsible party.
